Some districts, e.g., Chicago, are starting to take the obligation to offer options seriously, but most are not. Some districts suppress parent interest in options via late or vague notification, or that make it clear that getting an alternative placement is improbable, then claim that parents aren't really interested anyway.

Somwething like this happened early in the implementation of Title I: some states and districts wouldn't provide required services for eligible children in non-public schools. So Congress created a bypass provision, where funds went to institutions other than the district. Something like this might ultimately be necessary, e,g, creating a statewide school district that creates options (via chartering or direct operation of new schools) for children in districts that don't really provide the alternatives required by NCLB.
