NCLB requires chartering as a last resort, when a lot of reasonable measures have failed for an unreasonably long period of time. Chartering doesn't guarantee success, but its odds are better than continuing to work with a school that just can't improve.

Chartering is one way to get an option. It can work well or badly depending on who gets the charter, which depends a lot on the diligence of the chartering agency. Districts can decide whether they will charter carefully (see Chicago), thus making it likely that a new school will be pretty good, or charter at random (see the DC school board).
